THE HOPS ARE FREE

Official confirmation from Governor’s Chief of Staff. If someone tells you he hasn’t signed it, they just haven’t been informed yet. It is a done deal. HB373 is now the law of Alabama.

This a great day in Alabama for the cause of freedom! With so many freedoms being taken away from us in this country right now, it is wonderful to see a grassroots effort like Free The Hops take a practical stand for freedom and being successful. I’m reminded of the Schoolhouse Rock cartoon “I’m Just A Bill”

Free the Hops, nowwwww your a lawwww! Oh Yeah!

This is great, but if I read HB 373 correctly, the stronger beer can only be sold for on-premises consumption. The second paragraph of section 3 limits sell for off-premises consumption back to 6%. This provision wasn’t in SB132. Am I reading this right??

    • Jeremy
      Posted May 22, 2009 at 10:35 am | Permalink

Anyone care to clarify this passage?

“Beer or malt or brewed beverages sold by the holder of a retail beer license for off-premises consumption pursuant to Section 28-3A-17 shall only include any beer, lager beer, ale, porter, malt or brewed beverage, or similar fermented malt liquor containing one-half of one percent or more of alcohol by volume and not in excess of five percent alcohol by weight and six percent by volume, by whatever name the same may be called.”

      • Jeremy
        Posted May 22, 2009 at 10:36 am | Permalink

I’m assuming “Section 28-3A-17 ” refers to the whole package store debacle?

      • Jeff
        Posted May 22, 2009 at 10:39 am | Permalink

The phrase “off-premises consumption” modifies “license” NOT “beer or malt or….” This has been discussed at length in the forums. Stores will need an “on/off” or “on” premises license to sell the beer. Many grocery stores already have “on/off” licenses b/c they host wine tastings. It’s not a trivial issue, but it’s not a big deal either.
